Nursing Homes and Wrongful Death

It is not uncommon for nursing facilities and long-term care homes to be involved in lawsuits, even those involving wrongful death. Negligence on the part of the nursing facility staff are often cited as the prime causes of an injury or death for their residents. Patients and family members of patients have the right to bring these care facilities to justice and collect any compensation they deserve. A recent wrongful death case involving a facility has led to some new laws to help beneficiaries of an estate recollect the money that had been allocated toward medical expenses.

Wrongful Death Suit in Oklahoma

Colonial Terrace Care Center LLC is a long-term care nursing facility in Oklahoma that has recently been involved in a wrongful death claim for a deceased patient. According to reports, the administrator of the estate of the deceased patient filed the petition in Mayes County District Court. The patient was admitted to the care facility following injuries related to an automobile accident. Colonial Terrace Care Center LLC was meant to be a place for the patient to receive continued care after being released from the hospital.

According to the lawyer involved in the wrongful death suit, the employees at the care center were negligent in their work, which possibly caused the death of the patient. Additionally, the petition states that the estate had incurred medical expenses, which ultimately damaged the heirs of the estate. The attorney involved in the case is currently seeking an excess of $75,000 in total compensation. Currently, the case is still underway but should be a caution to any and all long-term care facilities that all regulations should be followed at all times to ensure proper patient care.
